We have a sticky one that the individual has lost self-build exemption due to no commencement notice now owes £28K of CIL. However he had an architect that was acting on his behalf and all original information went to the architect. 

The Liability Notice was in his name and originally showed the self-build exemption but we did not send it to him we sent it to the agent. He is saying we didn't serve it on him and therefore wasn't served correctly. At no point were we advised that information should not go to the agent and the application was all C/O.

Since the disqualifying event I have reissued a new Liability Notice without the exemption and this has all been served on him, which I think is fine now and I can recover the CIL......

But I just wanted to check.Has anyone ever had this that a applicant is saying a Liability Notice isn't served on them because it has gone to an agent?
